days away from halloween. this is "today in the bay." how do you do. good morning. 4:31. i'm marla tellez in for jon kelley. >> i'm laura garcia-cannon. a lot to get to. let's check that forecast with meteorologist christina loren. good tuesday morning. >> good morning to you. everybody at home. it's cold out there this morning. we're going to see a nice rebound to the day. good idea to layer up. 56 degrees now in livermore, in the north bay has our first frost advisory issued for the entire season. that's in the higher elevations so keep that in mind in the north bay mountains. you might wake up to frost on the windshield or the lawn. throughout the day today temperatures are going to warm up and then we keep climbing. we'll look at the seven-day forecast in moments. right now let's check your drive. ants knee slaughter is in for mike. >> things are looking pretty good.

it's still early, 4:31. no accidents causing slowdowns. let's look at 101 northbound in san jose. traffic moving smoothly. quite a few cars in this area. we have an accident in san jose at 87 at 85. it's not really slowing traffic in any direction, so that's the good news if you can slip over to the traffic maps you can see that on the map. you can see the green does indicate that cars are getting through. this is a two-car accident at 87 and 85. nothing else to report right now. >> we'll check back with you. a story you'll only see on nbc bay area, court proceedings begin for one of six teens charged with killing a paramedic. now almost seven months after quinn boyers murder his widow is speaking. liz boyer says her husband was shot in the head weeks shy of their one-year wedding anniversary. two years late ter first

responder was taken off life support. then came the arrest and the revelation the accused are just boys. >> a quick check list of the last time i told him i loved him. when's the last time we had a laugh, what did we do yesterday. when i heard how young they are i just -- i felt sick to my stomach. i felt bad. this is senseless. and it's loss all around for everyone. >> the accused triggerman is just 16, he is being charged as an adult. five other teens a s are charge. boyer was shot during an attempted carjacking. >> hundreds are expected to march hours before the 13-year-old who was killed by a sonoma county sheriff's deputy is laid to rest. according to a facebook post on the justice for andy lopez facebook page, two groups of marchers will gather around

noon, one at the old court house square and another at santa rosa's union college. both will march to the sheriff's deputy. a deputy shot lopez because the deputy thought boy pointed an ak-47 at him. the weapon turned out to be a replica ak-47. the funeral is 5:00 tonight. >> breaking news we brought you yesterday's show, this morning a south bay woman behind bars facing vehicular manslaughter for allegedly killing her friend. monica johnson of campbell was drunk driving when she hit and killed cassandra buck. it happened on weibel way. she backed into buck and pinned her against the garage door. police believe the women were in the car before the crash. they also found beer cans. >> the suspected drunk driver who ship a couple is expected in

court. marjorie was supposed to appear but was a no show because of health issues. prosecutors say she ran down the couple as they walked their dog. reitzell's brother tells us he has no idea what happened. he says that reitzel is bipolar. she has had 30 criminal casings against her in san mateo county including dui and drug charges. she faces vehicular manslaughter charges in this latest case. >> the 20-year-old ymca worker accused of molesting children will be back in court to enter a plea on additional charges. police say nicolas is now accused of molesting four young girls. one just 3 years old. all of the victims attended ymca day care on the campus of the elementary school in morgan hill f. convicted he faces life in prison. >> jury deliberations begin

today in the trial of a marin teen accused of stealing guy fieri's lamborghini. he confirmed he never gave anyone permission to drive his car. max swayed accused of stealing the lamborghini and charged with shooting at car carrying a girl he had a crush on. >> the end of daylight saving time comes sunday. this means for most of us we will be heading home from work next week in the dark. san francisco police say when we rolled the clocks back last year it saw an increase in robberies near transit hubs and smart phones are actually the target often. so police are heading out this morning handing out information to remind commuters a smart phone glow will shine an hour earlier. >> we noticed there was an increase in some robberies around the transit hubs and realizing that people's commutes were during darkness we wanted to get information out to advise the public of that.

>> they hope to shine a light on the dangers in the dark. officers plan to be more visible during the evening commute. >> someone is breaking into homes in the los gatos mountains. later today law enforcement officials will meet with members of the community to discuss what to do about it. deputies from the santa clara and santa cruz county sheriff's department plan to update the community about recent crimes. according to the santa cruz patch signs have been posted on several roads in the mountains warning people about the rash of burglaries. other crimes including dogs getting beaten have also been reported. officials will also give public safety tips and advice how to avoid becoming a victim. >> students and teachers at one east bay school are protesting a planned visit by new uc president janet napolitano. she is set to speak at oakland tech high school later this week but organizers say they do not want her on campus and they are gathering signatures for a

petition calling for her removal as uc president. they say her work as former homeland security secretary makes her a poor fit for a system that has frequent student protests and enrolls undocumented immigrants. >> in san francisco an old hotel coming down to make way for a new hospital. the california pacific medical center is holding a ceremony to celebrate the demolition of the former cathedral hill hotel. a new state of the art seismically safe hospital will take the hotel's place near the corner of van ness and geary. it should be ready to open in 2019. >> yesterday we gathered here and talked about the wind. this morning it's pretty calm. meteorologist christina loren, good morning. >> good morning to you, marla, laura, everybody at home. the ingredients for fog. we don't have thick fog but we expect that to develop. you'll notice the top of your

welcome back. taking a live look outside. beautiful. that's in the south bay overlooking san jose. you made it to tuesday morning. we'll have a look at the chilly forecast coming up with christina. it's 4:43. lawmakers look for answers whether the u.s. has been spying on its allies and who knew about it. today the house intelligence committee hears from the head of the nsa, and the director of national intelligence, and the justice department. they will testify on what type of stlans the national security agency can and cannot do. the white house says president obama was not aware the nsa was spying on world leaders including german chancellor angela merkel. the leak came from documents

stolen by edward snowden. >> yahoo!'s ceo is the owner of the oldest funeral home. marissa meyer is the new owner of the funeral home located on more than an acre on the corner of middlefield road and addison avenue about a block east of meyer's home. sourlss told the paper they think that meyer is going to use it for residential purposes. they will go out of business in two days on halloween. >> this morning the birthplace of the apple computer is officially part of history. the los altos historical commission voted unanimously to turn the childhood home of late co-founder steve jobs into an historical site. it means the home is now protected so a builder cannot come in and demolish it. the plan is to put up a plaque in front of the home where jobs and steve wozniak built the first 50 apple one computers in

1976. jobs' stepmother marilyn jobs still lives in the house. >> i was wondering that. interesting. speaking of apple analysts will keep an eye on the company shares. they saw a slight drop as apple's quarterly profits fell again. for that and the rest of the news before the bell we turn to seema mody. good morning. >> good morning. futures higher after a mixed close on monday. s&p 500 rising for the eighth time in nine days hitting another record high. a report on industrial production topped forecasts but operate data showed a drop in pending home sales. data today on inflation and consumer confidence and the fed begin as meeting, the dow slipping one point. as you said wall street will watch shares of apple. the quarterly profits fell for the third period though they did beat forecasts.

thanks to the launch of the iphone 5 s and 5c. google is set to expand the roll out of its glass technology. reports say it will release more units of the devices in the coming weeks. only about 10,000 have been given out so far to contest winners and early adopters. similar to how it introduced gmail reports say google will let existing owners to invite a small group of friends to buy. >> thank you so much. $8 for a gallon of milk? that could be our reality if congress does not pass a new farm bill and soon. current subsidies run out the end of the year. congress is yet to pass new subsidies because of a disagreement over cuts to food stamps. the price after gallon of milk

could soar to 6, 7, or $8 a gallon. >> for congress not to pass the bill yeah it is. it's ridiculous. >> the price is high at times, a gallon of gas is comparable to a gallon of milk so it's pretty much the same. fill the car up or the boy up for nutrients for life. he comes first. >> expensive bowl of cereal. a family buying a gallon every week would spend $250 more. congress is set to debate the bill this week. >> the cost of a can of soda will be the topic at today's board of supervisors meeting. one supervisor is proposing 2 cents per ounce tax on sugary drinks that works out an extra 25 cent as can. scott wiener thinks it will pass because the money around $31 million would go toward youth nutrition and physical activities program. also on the agenda a planned

vote on a proposal to close all city parks between midnight and 5:00 a.m. >> as we begin talking about yesterday, it's that time of year again. ski and snowboarding season is around the corner. the sierra got its first dose of heavy snow monday. look at that. getting to look a lot like christmas. and snow machines near truckee spent the night making snow to capitalize on the conditions. if the snow keeps falling it will open this weekend. north star, another resort, hopes to open later in november. >> that's the lower one as you head up there. by truckee. boreal. >> grab the triplets. how cute t bean es and ear muffs. >> one of those mornings if you are taking your little ones to school make sure they are ready for a cold stafrmt layer them up. it's going to be a nice finish.

temperatures holding on to comfortable levels as we head through the afternoon before you know it we will be well into winter so take advantage of the upper 60s to low 70s that we are expecting. temperatures are chilly. i can tell you we have a little bit of shower activity expected. not a lot. mostly down over the santa cruz mountains. we stop the clock at 8:00 a.m. you can see that cell passing over 17. you might have to use your wipers. we're looking good. stop the clock again by 1:00 p.m. a fair mix of sun and clouds. it's going to be kind of a nice fall day but not too bad. 67 degrees on the way to livermore. a little something on myself, fix that up. 61 degrees today in fremont so we're looking good there. here's the deal. temperatures are going to swing all around as we head throughout this week so 67 degrees up to 71 tomorrow. thursday into friday, temperatures start to climb. we'll be at 79 on friday.

then getting into this weekend, don't want to you forget time change. we fall back, that means you gain back that hour of sleep we lost in the spring. so that's the good news. we need it on this shift. over to you, marla and laura. >> we'll take what we can get, won't we. it's 4:50. it's been a year since the northeast was devastated by superstorm sandy. while some are commemorating the lives lost, there is still a lot of work to be done. the storms killed 180 people, causing more than $62 billion in damage across several states. new jersey certainly hit hard. in reeds beach abandoned homes and businesses stretch for miles. near atlantic city the storm washed away a portion of the famed boardwalk. the area had a strong initial recovery but just last month you recall that massive fire destroyed 50 businesses on the recently rebuilt boardwalk. the fire was caused by wiring that was damaged, ironically,

during the storm. >> florida sixth-grader hopes his invention will minimize damage in the next hurricane, a sand bag without sand. peyton won first place for his design at the 3m young scientist challenge. he replaced the sand with polymer and salt. since it does not inflate until it touches water there are less gaps adding increased flood protection. he was inspired by superstorm sandy and hurricane wilma. >> when i was 4 i experienced wilma and it was a terrifying experience, all the sounds and noises. it would be beneficial buy sandbags to work in any flooding whether it's rain water or salt water. >> this is not peyton's only invention. when he was 8 he invented a golf ball temperature preserver and two years later helped his

today marks 100 days until the winter olympics in russia. the games are expected to be the most expensive winter olympics in history with the current overall price tag at $51 billion. almost all of the olympic venues have been built from scratch and most of the sports facilities have been completed. there will be 12 new events at this olympics including women's ski jumping, and slope style snowboarding. when the time comes you can watch all of the action right here on nbc bay area. >> here before you know it. former giants slugger barry

bonds is back in the headlines this morning, asking a federal appeals court to reconsider its refusal to overturn his felony obstruction conviction. the three-judge panel upheld the conviction last month after a jury found him guilty two years ago. the all-time home run king is now asking the durt court to assemble a special panel. >> let's look at the roads with anthony in for mike today. >> good morning. things are quiet. makes it easy for me for the time being. we're talking about one accident over the san mateo bridge, if you keep on past 280 at 35, that's where we have an accident. it's keeping some things slow but over the bridge a little foggy, hazy and drizzle according to meteorologist christina loren. she'll talk more about that coming up in a bit. over to the other side of the bridge you can see the same thing, a little hazy look.
